The Constitution envisioned a system in which the judiciary would serve to check the excesses of the legislative or executive branches. But today, federal judges have far exceeded their intended role, becoming little gods in our republic. They have lifetime appointments, and their only accountability is the potential for impeachment.

But in the history of our country, only 15 judges have been impeached by the House of Representatives. Of those, four were acquitted, seven were convicted, three resigned and one is still pending. In other words, Congress almost never removes federal judges. For all practical purposes, the checks and balances of the federal government no longer exist. The judiciary trumps. Our country is basically now run by judges.

Thomas Jefferson warned about this possibility in a Sept. 28, 1820, letter to William Jarvis: “You seem … to consider the judges as the ultimate arbiters of all constitutional questions; a very dangerous doctrine indeed, and one which would place us under the despotism of an oligarchy. Our judges are as honest as other men, and not more so … and their power [is] the more dangerous, as they are in office for life and not responsible, as the other functionaries are, to elective control. The Constitution has erected no such single tribunal, knowing that to whatever hands confided, with corruptions of time and party, its members would become despots.

“The Founding Fathers understood the selfish and sinful nature of man and therefore divided the government up so that no one branch would be all powerful over the other branches or over the American people. What we have today is judicial tyranny and exactly what Jefferson feared. Unless Congress asserts its constitutional power of impeachment, judges will continue to impose their personal opinions on whatever controversy is before them, regardless of what the Constitution does or does not say.

Judge’s ‘sexual proclivity’ compromised ruling (OneNewsNow.com)

There’s no question that this judge was definitely not the one to try this case. Prop 8 defenders trusted that he could put aside his lifestyle choice and rule fairly, but this clearly wasn’t the case from the tone and much-protesting of his novel ruling.

In a press release yesterday, AFA identifies Walker as a “practicing homosexual” who, for that reason, should have recused himself from this case “because his judgment is clearly compromised by his own sexual proclivity.” Fischer concurs.

“It’s really no different in our judgment than having a judge who owns a porn studio being asked to issue a ruling on an anti-pornography statute,” says the AFA spokesman. “There’s a conflict of interest there.”

Back in 2004, I was part of a small group of Republican senators that forced a floor vote on a motion to consider a constitutional amendment defining marriage as being between a man and a woman. We needed 60 votes to proceed; we fell just short of 50. Many senators who voted “yea” privately castigated me for making them “walk the plank” on such a tough issue.

A majority of Americans still supports traditional marriage. It has been on the ballot in 31 states and won every time. However, the inside-the-Beltway power centers – the media, campaign contributors, and politically active special-interest groups – passionately want to, as the 2004 Massachusetts majority opinion put it, “eradicate that stain” on our country.

That’s why, when last week’s ruling in Boston knocked down the last defense against judicially mandated same-sex “marriage,” there was largely silence from the political class.

With the exception of a core group of conservatives, most politicians – including the president – continue to publicly back marriage while eagerly awaiting the day when judges will take this issue out of their hands. In this case, silence, as my former colleague Zell Miller once said, is not golden; it’s yellow.

THE much-anticipated trial to determine the constitutionality of California’s Proposition 8 is scheduled to begin this morning in the case of Perry v. Schwarzenegger. What’s at stake in this case, filed in federal district court in San Francisco on behalf of two gay couples, is not just the right of California voters to reaffirm the definition of marriage as only between a man and a woman, but also whether marriage may be otherwise defined in any state.

The entire premise of this litigation is disquieting — that traditional marriage is nothing but “the residue of centuries of figurative and literal gay bashing,” as David Boies, a lawyer for the plaintiffs, has written. According to the plaintiffs, there is just no rational basis for government to privilege marriage between a man and a woman. Thus, in their minds, Proposition 8, which was supported by more than seven million California voters, could have been adopted only as a result of “animus,” as the complaint puts it, toward gays and lesbians.

President Obamas “Safe Schools Czar,” already a target of social conservatives for his past drug abuse and what they say is his promotion of homosexuality in schools, is under fresh attack after it was revealed that the pro-gay group he formerly headed recommends books his critics say are pornographic.The group under fire is the Gay, Lesbian and Straight Education Network GLSEN, which Kevin Jennings, now the assistant deputy secretary for safe and drug-free schools in the Department of Education, founded and ran from 1990 to 2008.GLSEN says it works to create a welcoming atmosphere for homosexual students in schools, and that effort includes recommending books for students of all ages.

Another Blow for Gay Advocacy, Playboy bunny Stephanie Adams Switches teams, again.

Stephanie Adams, Miss November 1992, was the first and only Playboy Playmate to declare herself a lesbian. But she’s switched teams. Adams — named “best NYC lesbian sex symbol” in 2004 by the Village Voice — is engaged to marry “a loving, supportive, successful man,” she informs Page Six. “I would like for his privacy to remain intact, but I will say that I intend to retire from being a public persona so that we can settle down and have children . . . Life is good . . . I have no regrets for anything.”

Whoops! Lesbian ‘Person of the Year’ in Gay Press Goes Straight With Baby | NewsBusters.org

In December 2005, Kerry Pacer, then 17, was featured on the cover of the national gay news magazine The Advocate as its “Person of the Year” — making her the youngest gay person to achieve that honor – for fighting for a “gay-straight alliance” at White County High School in Cleveland, Georgia. But there’s apparently no embarrassment for the gay press….when she takes on a boyfriend and they have a baby. In The Washington Blade, Dyana Bagby reported:

But today she lives with her boyfriend, a construction worker, and their baby daughter, Marley, who turns 1 year old on Saturday.

American Thinker: Left-Wing Media Bashes Adam Lambert.

Those on the left who have criticized religious Christians for making Adam’s sexuality an issue are guilty of the same.  If Christian is deemed to be an American Idol voting block, then gay is a political movement rather than a sexual orientation.  Showing the true colors of at least some in the liberal media, Joseph Penn, writing for the San Diego News Network explained that it’s important for Adam to come out so that LGBT kids have a role model “so long as he doesn’t come out as a gay Republican [emphasis added] .”

Sad.
